DESIGNANDPRINT.sg, a domain wholly belong and operating under the entity of THE EXTREME GROUP INTERNATIONAL PTE. LTD. (Unique Entity Number: 202002310W), a company incorporated in Singapore and having its registered office at 22 Sin Ming Lane #06-76, Singapore 573969 (hereinafter mentioned as "DesignAndPrint.sg", "our" or "us") has provided this website https://designandprint.sg/ ("Website" or "Website Operator") and all products and/or services subject to the terms and conditions set out below.

These terms and conditions ("Terms", "Agreement") are an agreement between Website Operator  ("DesignAndPrint.sg", "us", "we" or "our") and you ("Client", "Customer", "User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the "DesignAndPrint.sg" website and any of its products or services (collectively, "Website" or "Services").

By reading these Terms and Conditions carefully, you("Client'', "Customer", "User", "you" or "your")   agree, understand and accept that the following terms and conditions serve as the contents of the legal agreement between you and us, and which may be modified from time to time at DesignAndPrint.sg sole and absolute discretion without prior notice. These Terms and Conditions provide you with a detailed overview of what you must consider before accessing and using the Website, and/or purchasing DesignAndPrint.sg’s products and services.

 

ACCOUNT & MEMBERSHIP

The Website can be used without registering an account. However, registration is required to purchase the products and services. An email address is required to register and by providing one, you allow DesignAndPrint.sg to contact you for the purposes set out in these Terms and Conditions.

  • You will be asked to provide consent to these Terms and Conditions at the point of creating an account on the Website. By ticking the acceptance box, you agree to these Terms and Conditions, as well as DesignAndPrint.sg and our representatives' collection, use and disclosure (including overseas transfer) of your Personal Data (being any data or information about you from which you can be identified either (A) from that data, or (B) from that data and other information to which we have or are likely to have access), as well as our representatives' use, collection and disclosure of such Personal Data to our authorised service providers and/or any relevant third parties in accordance with these Terms and Conditions.
  • You must be at least 13 years of age to use this Website. By using this Website and by agreeing to this Agreement you warrant and represent that you are at least 13 years of age.
  • If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.
  • We may monitor and review new accounts before you may sign in and use our Services.
  • Providing false contact information of any kind may result in the termination of your account.
  • You must immediately notify us of any unauthorized uses of your account or any other breaches of security.
  • We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration..
  • If you are registering on behalf of a legal entity, you also represent and warrant that you are authorised to act on behalf of the legal entity to enter into contractual arrangements, to bind the legal entity to the Terms and Conditions, and register with us an account for and on behalf of the legal entity. In these Terms and Conditions, all references to "you" and "yourself" means the account holder, whether an individual or other legal entity.
  • You agree to provide true, accurate, current and complete information about yourself and that you will immediately update such information when it changes. Information found to be false or incorrect may lead to your account being suspended or terminated along with any associated orders. If a dispute arises from information being incorrectly entered by you, DesignAndPrint.sg shall not be held liable for any costs incurred.
  • You are responsible for all products and services ordered on your account and agree to securely store and protect your account information. If you become aware of any unauthorised use or possible compromise of your credentials, you must immediately notify DesignAndPrint.sg in writing. If any products and services were ordered with a compromised account DesignAndPrint.sg will investigate. Payment for any costs incurred by a compromised account may still be required.

DesignAndPrint.sg will comply with lawful requests and court orders to release information to law enforcement, relevant enforcement bodies or as part of active legal proceedings.

Placing an Order and Payment Procedures :

All products and services are subject to availability. DesignAndPrint.sg reserves the right to reject any order at any time, in its sole and absolute discretion, with no reasons required to be given. Orders are only confirmed upon your receipt of a written order confirmation from DesignAndPrint.sg.

DesignAndPrint.sg 's products and services may be modified at any time due to constant product development. DesignAndPrint.sg will not guarantee to deliver the exact same products and services when reordering at a later point in time.

 

PAYMENT METHODS, OBLIGATIONS OF PAYER, AND TRANSFER OF OWNERSHIP.

DesignAndPrint.sg accepts several payment methods including Online Payment using STRIPE, Credit Card, bank transfer, cash on delivery (COD), Bank Cheque and Credit Invoices under certain circumstances. Whichever payment method you are using, you agree that:

You have the relevant authority to use the payment method;

You have sufficient funds or credit facilities in place, and;

We may provide you with further instructions or terms that you must follow and agree to before using your chosen payment method.

DesignAndPrint.sg reserves the right to request and obtain validation of your payment method before processing your payment. If the transaction is rejected, the associated order may be cancelled.

Bank transfers: The order will only be processed when the payment is clear and available in DesignAndPrint.sg’s accounts. You must also upload proof of payment (such as a payment or deposit receipt).

Due to different payment timelines from banks, orders might not be processed until the funds have been cleared and received DesignAndPrint.sg.

Transfer of ownership of products and professional services rendering will only take place upon DesignAndPrint.sg providing you with confirmation of receipt of full payment.

 

CURRENCY AND TAXES

Prices on the Website are stated in Singaporean dollars and are inclusive of GST unless specifically indicated otherwise. You are responsible for any other applicable taxes or customs duties that may be incurred.

The price includes packaging and delivery charges but excludes shipping insurance. Any changes requested by you after the order confirmation may incur additional costs (such as for proof prints).

If you wish to deduct certain locally applicable withholding taxes you must choose either bank transfer or a credit invoice as a payment method.

 

4. PROMOTIONS, DISCOUNTS, OR WRONGLY DISPLAYED PRICES.

DesignAndPrint.sg reserves the right to cancel or reject coupons or promotional prices at any time without providing any reason.

In the event of a genuine error, DesignAndPrint.sg reserves the right to cancel orders placed with incorrect prices (for example if there is a typographical or technical error resulting in incorrect prices being displayed on the Website or elsewhere).

 

BACKUP & SUBMISSION OF CONTENT & INFORMATION

We are not responsible for Content residing on the Website. In no event shall we be held liable for any loss of any Content. It is your sole responsibility to maintain appropriate backup of your Content. Notwithstanding the foregoing, on some occasions and in certain circumstances, with absolutely no obligation, we may be able to restore some or all of your data that has been deleted as of a certain date and time when we may have backed up data for our own purposes. We make no guarantee that the data you need will be available.

We may from time to time offer the following options when using our printing service:

File Upload. DesignAndPrint.sg will reserve the rights to conduct a standard check and proof prints which may be done for an additional service fee.

 

BRANDING & DESIGN SERVICES.

Upon request, DesignAndPrint.sg will engage with you to create a custom design for your products and services (digital or hardcopy) at additional service fee or professional design and prints services rendered.

- UPLOADING OF FILES (ARTWORKS & PROJECT SPECIFICATIONS)

  1. It is the client responsibility to have information and instruction clearly provided to DesignAndPrint.sg in order for us to provide a responsive form of communication.
  2. The supplied artwork files must be in the specified image format and size required by DesignAndPrint.sg.
  3. DesignAndPrint.sg’s instructions on file uploading can be found in www.designandprint.sg

 

APPROVE OF DESIGN / PRODUCT & SERVICE ORDER CONFIRMATION

Upon confirmation on AOD (Approve Of Design) & SOC (Service Order Confirmation) on designs and artworks, DesignAndPrint.sg will process your order. Failure to respond to DesignAndPrint.sg after the Request for AOD is issued to the client within 7 days DesignAndPrint.sg may cancel the order. You may be liable for all costs and expenses incurred at your (Client) instruction prior to cancellation.

Once you have approved the final design, you agree that DesignAndPrint.sg will not be held responsible for any errors made within the designs, artworks, including spelling and grammatical mistakes.

Upon AOD (Approve Of Design) & SOC (SERVICE ORDER CONFIRMATION) DesignAndPrint.sg shall continue to proceed with production based on client AOD “as it” and “it is” basis. Onwards, no cancellations or suspends of an order will be accepted and request of refund will not be entertained.

During Approve Of Design phase, it is your (Client) responsible to ensure and verify for avoidable mistakes before you issue/endorse DesignAndPrint.sg the AOD“Approve Of Design”. This includes, but is not limited to:

  • Spelling, spacing, grammatical errors;
  • Damaged fonts;
  • Transparency issues;
  • Incorrect file uploads;
  • Imperfect bleed or colour conversions;
  • Low-resolution graphics and images;
  • User-selected options such as size, quantity, and paper.
  • Ensure foreign fonts or scripts (e.g. Chinese or Thai) are displayed correctly.

 

DesignAndPrint.sg’s design team will out of goodwill do their utmost to be mindful of these issues and assist you (Client) to perform a final check but should not and will not be held responsible when the above-mentioned issues.

 

PRODUCTION DEVIATIONS

No print run is identical, and deviations may happen due to different techniques and materials. For potential deviations DesignAndPrint.sg shall propose the following resolution for issues mentioned below, to ensure the integrity and quality of products and services rendered to be as true as possible to the design approved.

  • Colour Deviations

Colour deviations do occur and accuracy may slightly deviate from the provided artwork files. When placing an order with DesignAndPrint.sg, you (Client) are to be acceptable to certain limitations regarding the colour accuracy. This includes, but is not limited to:

  • The same colours as previous print run;
  • The same colours compared to digital proof colours, up to 5 % deviation;
  • The same colour within a print-run (first vs. last).
  • Deviation in physical dimensions (Size/Cutting/Etc.)
  • The deviation in size can be up to 3mm;
  • The deviation of the cutting position can be up to 2mm;
  • Orders can be printed with up to 5% variation in size;
  • The position of folding can deviate up to 1mm;
  • Imperfect hot stamp registration can be up to 0.5mm;
  • Imperfect spot UV registration can be up to 0.5 mm;
  • Imperfect embossing registration can be up to 0.5 mm;
  • Bleed mirroring deviation in case of an imperfect bleed.

Please Note: There is no guarantee for the same colour as compared to the screen or online proof colours. There may be significant changes when changing from the screen calibrated RGB to the printer based CMYK profile. Every monitor screen can or will show different colours, independently of the exact colour profile;

  • Deviation In Quality

Due to unforeseen circumstances of Production Under-Run, DesignAndPrint.sg shall not warrant that every order will equal the exact amount of the items ordered. There might be a deviation of above or below the ordered amount.

During Production Under-Run situation, sg will issue a credit note to be used for next orders/purchase or ;

DesignAndPrint.sg will directly refund you (client) (based on Pro-rata adjustment - item price multiplied by missing quantity).

 

PROOFING PROCESS

DesignAndPrint.sg offers different methods of proofing before releasing your order to production. Some are included in the design price and some will be available at an additional cost. We mainly distinguish between:

Online proof: Included in the purchase price. The purpose of the online proof is to check whether all the elements are in place, and not to check the colour accuracy. Hence, it can display significant differences to the final product in terms of colour accuracy;

Digital Proof Print: Charged on an item by item basis. The proof print is colour-proof and will be closer to the final product, with a possible deviation of up to 20 %.

Unless conveyed to and agreed by DesignAndPrint.sg, the proof print will not be laminated and may not be on the same paper type/specifications/size as what you have ordered for the final product.

 

PROMOTIONAL PRODUCTS

Promotional products might have +/- 5% colour deviation both within the same and especially between different orders. Some of the printing colours oxidise over time and / or might change when exposed to light.

DesignAndPrint.sg  at our utmost effort to print on the actual product according to the artwork specification, though it is understood that the print artwork dimensions and location might vary of +/-  1 (one) centimetre.

 

DELIVERY & SHIPPING

Local Delivery & Shipping Fee for the small and medium items are chargeable, not more than S$8.00, for the big and bulky item, a fee may vary.

Shipping address, contact person name and number are required when submitting the product or service order to DesignAndPrint.sg.

Change of shipping address in special cases and in consultation with DesignAndPrint.sg are not acceptable, depending on the state of production and the booking arrangement with freight forwarders for the shipment to countries or state, additional shipping fee may be charged.

When Incorrect or out of date shipping address are provided, DesignAndPrint.sg is not responsible for any extra costs incurred in delivering the order and extra shipping fee may be charged to you (Client).

DesignAndPrint.sg reserves the right to decide on which model of transportation or shipping arrange to apply and if through either partial shipment or full shipment with the consideration of the most cost-efficient and appropriate delivery service requirement.

DesignAndPrint.sg will not be liable for any loss or expenses arising from any delay.

 

ACCEPTANCE & PROOF OF DELIVERY

You (Client) agree to inspect the received products and services upon delivery and confirming that delivered products and services are free from any apparent defects or damage.

When products and services are damaged upon delivery, within 7 working day, you(Client) must specifically note the damages and feedback to DesignAndPrint.sg for next cause of action.

DesignAndPrint.sg will not entertain any complaints on defects or damaged goods after 7 working days have passed upon signed DO (Delivery Order) date.

You (Client) shall continue to accept delivery based on a short-ship or delayed delivery due to partial shipment.

 

RE-SCHEDULING & AMENDMENT OF DELIVERY DATE

DesignAndPrint.sg will not be liable or held accountable for any costs incurred for late delivery relating to the following circumstances : -

  • Late submission of documents relating to your payment method (e.g. confirmation of bank transfer);
  • Submission of your(Client) artwork after the artwork submission deadline has expired;
  • Faulty uploaded artwork which needs to be corrected;
  • Late approval or non-approval of proof prints or online proofs;
  • False, inaccurate, out of date, or incomplete delivery address or other required information.

 

CANCELLATION OF PURCHASE OR SERVICE ORDER

No cancellation of orders will be allowed or entertained for whatsoever reason upon you(Client) signing the AOD (Approve Of Design) and disposal fee is applicable for the quantity of order produced.

You may cancel the order after 15 days from purchase or service order date.

Or

When DesignAndPrint.sg has failed to deliver after 30 days of the agreed delivery date.

For request cancellation, the order for any of the abovementioned conditions, the notification sent to DesignAndPrint.sg must be in writing.

In the case of faulty products and services which breaches the statutory guarantees set out under the Consumer Protection (Fair Trading) Act (Cap. 52A) of Singapore, complaints will only be considered if the issue is raised to DesignAndPrint.sg within 7 days from the delivery date.

 

REPRINT AND RETURNS

Reprinting of defective products and services may be an option if feasible. For this to occur, you must return the full quantity of the defective goods. Production lead-times of reprints would stay the same with no artwork changes being permitted.

If there are no special reasons for return, then returned items will not be accepted.

 

REFUND

Only the same payment method or bank account that was used to make payment will be accepted to issue a refund. This will need to be approved by DesignAndPrint.sg management and will be processed within 14 days.

 

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, in no event will Website Operator, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to any person for (a): any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Website Operator has been advised as to the possibility of such damages or could have foreseen such damages.

To the maximum extent permitted by applicable law, the aggregate liability of Website Operator and its affiliates, officers, employees, agents, suppliers and licensors, relating to the services will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to Website Operator for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

To the extent permitted under applicable laws and regulations, DesignAndPrint.sg 's liability for any failure to comply with applicable laws and regulations or for any claims against us by you is limited to:

(i) Replacement of the goods or resupply of the products and services (as the case may be) or alternatively and in our sole and absolute discretion, replacement or supply of what we would deem to be equivalent products and services);

(ii) Repair of any defective goods;

(iii) payment of the cost of replacing the goods or acquiring what we would deem in our sole and absolute discretion to be equivalent goods or services; or

(iv) Payment of the cost of repairing the defecting goods.

DesignAndPrint.sg is not liable in any way for any:

Loss, damage, costs or expenses arising directly (or indirectly) from any failure or delay in performing any obligation under this contract, that is outside the reasonable control of DesignAndPrint.sg. This includes, but is not limited to strikes, failure of power, governmental restrictions, acts of god and breakdowns in electronic and computer information and communications systems.

Digital files sent by you which are accessed or disseminated by third parties outside of DesignAndPrint.sg control.

 

WARRANTIES AND GUARANTEES

Subject to applicable laws and regulations, DesignAndPrint.sg provides no warranty or guarantee except to the extent expressly provided in these Terms and Conditions.

 

INTELLECTUAL PROPERTY RIGHT

This Agreement does not transfer to you any intellectual property owned by Website Operator or third-parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Website Operator. All trademarks, service marks, graphics and logos used in connection with our Website or Services, are trademarks or registered trademarks of Website Operator or Website Operator licensors. Other trademarks, service marks, graphics and logos used in connection with our Website or Services may be the trademarks of other third-parties. Your use of our Website and Services grants you no right or license to reproduce or otherwise use any Website Operator or third-party trademarks.

You(Client) agree that DesignAndPrint.sg’s content that includes, but is not limited to, text, software, music, sound, photographs, videos, and any other material may be protected by trademarks, patent copyrights or other intellectual property rights.

You agree that you are only allowed to use material and information as expressly authorised by the respective owner.

Subject to applicable laws and regulations, DesignAndPrint.sg is the owner of its trademarks and trademarks used on the Website, as well as all information, documents, images, and material contained in the Website. Reproduction of same without DesignAndPrint.sg 's prior written consent will leave you subject to legal penalties.

PROHIBITED USES

In addition to other terms as set forth in the Agreement, you are prohibited from using the Website or its Content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

 

INDEMNIFICATION

By agreeing to these Terms and Conditions, you agree that you will defend, indemnify and hold us, our affiliates, and each of our officers, directors, employees, attorneys and agents, harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including legal costs and expenses) arising out of or in connection with:

  1. Your use or misuse of the products and services and/or Website; and/or
  2. With any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website or Services or any willful misconduct on your part and/or
  3. Your violation or breach of any of these Terms and Conditions or any applicable laws or regulations, whether or not referenced herein.

DATA PROTECTION

The main purposes for which your Personal Data is collected, used or disclosed by DesignAndPrint.sg, its authorized service providers and/or relevant third parties generally include:

Providing you with the products and services;

Account management;

Processing of payments;

Addressing queries, complaints and feedback;

Providing marketing and promotional offers (including loyalty and reward programmes) on products and services and personalised content and advertising based on your preferences or demographics;

conducting market research, understanding and determining customer location, preferences, and demographics for us to review, develop and improve our products and services;

facilitating business asset transactions;

protecting and enforcing our contractual and legal rights and obligations;

compliance with any applicable laws, regulations or guidelines; and

any other purposes in relation to the above.

You agree that we may use your contact details to send you promotional and marketing offers regarding our products and services. This may include the use of direct mail, landline phone, mobile phone, email, SMS, MMS and any other means that may be available.

Should you have any queries in relation to your Personal Data, wish to withdraw consent to the use of your Personal Data, obtain access to or make corrections to your Personal Data records, please contact DesignAndPrint.sg Data Protection Officer at customer.service@designandprint.sg.

DesignAndPrint.sg may publish a Privacy Policy or similar data-related policy on the Website. We agree to abide with any such policy, as amended by DesignAndPrint.sg from time to time. By accepting these terms, you acknowledge that you have read and agree with any such policies on the Website.

 

REJECTION TO INAPPROPRIATE CONTENT

DesignAndPrint.sg reserves the right to reject any orders for our products and services where we, in our sole discretion, deem the content to be inappropriate in our sole and absolute discretion. Inappropriate content includes, without limitation, any content which is unlawful, harmful, threatening, pornographic, discriminatory, profane or offensive, as well as anything that goes against moral and decent manners or could generate compensation claims, or harm unrelated parties.

 

COMMUNICATIONS

All communications with DesignAndPrint.sg shall be by way of email and addressed to customer.service@designandprint.sg.

 

WEBSITE

DesignAndPrint.sg is not liable for any costs resulting from any errors on the Website or if the Website is not available for any reason.

 

MODIFICATION OF TERMS AND CONDITIONS

All content on the Website, including but not limited to these Terms and Conditions, may be modified at any time at our sole and absolute discretion without prior notice. If you do not agree with any of the modified Terms and Conditions, please immediately discontinue and do not access or use any information on the Website, or submit an order to purchase any of the products and services.

 

REMEDIES AND WAIVERS

The rights and remedies provided in these Terms and Conditions are cumulative and not exclusive of any rights and remedies provided by applicable laws and regulations or otherwise. No failure or delay by DesignAndPrint.sg in exercising any right, power or privilege under these Terms and Conditions shall operate as a waiver of that right, power or privilege; and no single or partial exercise by DesignAndPrint.sg of any right, power or privilege shall preclude any further exercise of that right, power or privilege or the exercise of any other right, power or privilege.

 

CONTRACTS (RIGHTS OF THIRD PARTIES) ACT

Any person who is not party to these Terms and Conditions has no rights under the Contracts (Rights of Third Parties) Act (Cap. 53B) of Singapore to enforce any term of these Terms and Conditions, but this does not affect any right or remedy of a third party which exists or is available apart from the said Act.

 

GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore. By accessing this Website or purchasing any products and services through the Website, you hereby agree to submit to the exclusive jurisdiction of the courts of Singapore.

 

ACCEPTANCE OF TERMS & CONDITIONS

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Website or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Website and its Services.

If you do not agree with these Terms and Conditions, please immediately discontinue and do not access or use any information on the Website, or submit an order to purchase any of the products and services.
